Terms & Conditions:

When the machine is hired on a “daily rate”, the minimum charge of 9.5 hours would apply per day. The normal hours of operation [Lunch Break Included] are between 07h00 to 17h00 from Monday to Friday, and, between 07h00 to 16h00 on a Saturday, Sunday or Public Holiday.

Any additional hours after 17h00 on a weekday, or 16h00 on a Saturday, Sunday or Public Holiday will be subject to “over-time” and will be charged for.

Sundays and Public Holidays are charged at double the normal rates quoted above.

Invoices will be raised in accordance with the times and/or hours recorded and signed for on the time-sheet by the Operator and the Hirer, or, whenever necessary at the “minimum charge” of 9.5 hours per day.

Where the machine is unable to work due to Rain, Strikes, Industrial Action, Shut-Down, Pay Week-ends or similar related conditions or situations, the following rates would apply:
Daily Rate: Applicable Tariff x ½ (minimum 9.5 hours per day)

Payment terms are daily or weekly in advance. All deposit (which is negotiated per hire), delivery and collections charges will be billed on the first invoice. No Settlement Discounts are applicable on payments. An invoice for the afore-mentioned charges will be raised on receipt of this quotation, completed and signed by the Hirer.

Advance Payment for the invoice (deposit, delivery and hire), an Official Purchase Order and ID copy of the Signatory below are required before the equipment leaves our premises. Proof of payment must be e-mailed to jjtlbhire@gmail.com.

The machine is released to the Hirer on the premise that the machine would be used for general site / ground clearing and levelling, loading or unloading of sand / stone or similar materials, trenching / back-filling in normal soil conditions, in soft rock conditions and general rubble removal. Should the machine be subjected to any other use, the Hirer will be responsible for any damages, repairs or replacement costs as may become necessary due to such use.

The Hirer will be responsible in ensuring proper facilities and suitable / safe ground and site conditions for the safe un-loading and re-loading of the machine for transportation. Minimum mobilization time for equipment is 24 hours from receipt of this document (signed) and relevant deposit and delivery dates for any plant are indicative and is subject to change without prior notice.

The Hirer will be responsible for directing the safe use of the machine and ensuring that the machine / Operator are not exposed to any situations or ground / site conditions which may adversely affect the mechanical / physical condition of the machine, or, the Health and Safety of the Operator.

The Hirer is responsible for insurance, security and safe keeping of the machine on all sites, and is liable for all losses and/or damages to the machine.

The Hirer is responsible for repairs or replacement of damaged or broken (1) windscreens and windows (2) tyres and rims (3) tips and tip holders (4) trenching buckets and any mechanical or physical damage to the machine.

No Fuel must be left with operators as we accept no responsibility for any loss. Only fuel from a legal and registered supplier may be used in the machine. Any damage incurred and repairs effected as a result of “inferior quality” fuel will be for the account of the Hirer.

When applicable, the Hirer will be responsible for operator’s accommodation (including water / electricity) or travel costs to/from any site should suitable accommodation not be available within close proximity to the site. This determination is at the sole discretion of Omnitron cc t/a JJ TLB HIRE.

The Hirer hereby indemnifies and hold harmless Omnitron cc t/a JJ TLB HIRE against all losses and claims in respect of delays, death of or injury to any person, or, loss or damage to any property which may arise out of or in consequence of the execution and completion of any work and against all claims, proceedings, damages, costs, charges, penalties and expenses whatsoever in respect thereof or in relation thereto.

In the absence of the Hirer’s signed acceptance of this agreement, the delivery to, and, acceptance of the machine at the site nominated by the Hirer, or, the acceptance of the machine by the Hirer or their nominated Supplier for their own transportation to site, or, the receipt of any payments from the Hirer which relates to the hire of this machine would constitute the Hirer’s full and unconditional acceptance of these terms and conditions as stated.
